We are starting to use AI avatars in ads. What are the rules on disclosing that and how much trouble are we in if we skip it?

If your content is AI-generated or an AI tool substantially altered a real person, you likely have to disclose it. Several 2026 laws are converging, New York, the EU AI Act and California and the FTC now expects double disclosure on AI influencer content, marked both sponsored and AI-generated. Practically: label synthetic avatars and AI voices clearly and up front, put AI-modification terms in your creator contracts and decide who owns the label. Early honest disclosure does not seem to hurt performance much. This is general info, not legal advice.

Disclose synthetic content

AI avatars, voices and heavy alterations need a clear, upfront label.

Know the 2026 laws

New York, the EU AI Act and California rules are landing. The FTC wants double disclosure.

Put it in contracts

Define AI-modification terms and who owns the disclosure with each creator.

Honesty barely costs

Early data says upfront AI labels hardly dent performance. Hiding it is the real risk.

Double disclosure is the new bar: sponsored and AI-generated, both. We label up front and have not seen performance drop at all.

Get AI-modification terms into your creator contracts now. The risky move is AI-altering a real creator and publishing it unlabeled.

With New York, the EU and California all landing rules this year, treat labeling as standard. Cheaper than a per-violation fine.
